First lawsuit how to proceed

Hello everyone,

I’ve been on Vinted for a while now, and so far, everything has gone very well. I’m more of a seller than a buyer. I now have 60 positive reviews out of 60…

To get to the point, I had put up for sale a fairly large electric sports machine (10kg). A serious buyer expressed interest, asking me to lower the price by almost half (€18 instead of €30). I offered to sell it to her for €20.

I had checked that the machine was working properly when I posted the ad and before packing it. However, upon receipt, she opened a dispute, claiming the item was not working and smelled burnt…

I don’t know what to do. What makes me doubt is our exchanges; I found her a bit strange at times. Already during negotiations and initial questions, I never had time to respond. She even reiterated her €18 offer without discussion, only to finally accept my offer when I hadn’t yet been able to respond. I thanked her for her purchase and informed her of the package’s weight so she could be prepared. She acknowledged this.

I received a message the day after tomorrow asking if I had sent the package; it was a Saturday. I did my best to find a drop-off point that would accept my package, as most did not accept them on weekends. Then, around the time of receipt, she asked me the weight of the package and acted surprised, telling me it would be impossible for her.

3 days after the package was available, she told me she didn’t have a shipping label to pick it up. I suggested she use her name or check her email.

A few hours later, I saw the dispute notification… She supported her dispute with photos of the device, but the remote control needed for it to work was not included. It was only after I pointed this out and suggested she put batteries in the remote that she sent me a photo of the remote with batteries.

The Vinted user in question has only one purchase to her name and 1 positive review following it.

I really don’t know what to think. I felt so rushed by these exchanges, this sale, only to end up with this outcome, I’m a bit doubtful…

I would have had no problem refunding if the device had really been in poor condition or if I had had normal exchanges…

If you could tell me what you think, thank you very much.

Hello,
Welcome to the forum!

It is possible that this person already has a similar device and is trying to get a refund for it to get a new one « for free ».
Did you offer a return at their expense? This tends to calm down people in such cases.

Hello,

I will propose it to her. I am so afraid of doing her an injustice if she is telling the truth…

For the moment, I have contested the decision because in any case the device was in perfect working order before sending it.

What I find strange is that she herself assumes there is an electrical problem and then tells me « If you can refund me, I cannot use this device » without seeking another agreement or mentioning a possible return. Then, for having paid €25 for a defective device, I don’t find her very responsive in the conversation…

I am also afraid that she did not know how to use the device because I have already helped her many times with several things (solutions to retrieve the package, to get the shipping label, etc.).
