Account blocked with €5000

Hello,

I am writing to you today in despair. Like many of you, I first sold on my personal account before having to switch to a professional account because of Vinted’s reports.

The problem is that I was permanently banned today for suspected commercial sales (the reason why they ask us to go pro anyway :clown_face:).

I find myself with my account with 1000 followers, 500 reviews blocked and €5000 inaccessible…

I would like to know if you have any advice or if anyone else has managed to win their case.

Yes, their story about commercial sales is quite laughable when it comes to professional accounts. But in fact, for them, it means selling new products. And indeed, they ask you to go pro to sell new items but block or ban you if you do. In short, Vinted in all its glory.

Some have managed to get their accounts unblocked by harassing them with emails. It seems that mentioning the FEVAD (Federation of e-commerce and distance selling) in the conversation can help.

Normally the wallet is always accessible. If this is not the case, you must report it to them by saying that it is illegal, etc.

Generally, with persistent insistence, it eventually gets unblocked.

You have to be patient and persistent.

Thank you for the advice, I’m all ears if you have any more! I think I saw that there were employee emails that can make things happen.

And my wallet is indeed inaccessible; on the app I have « go pro » and on the PC clicking on the wallet redirects me to the blocking page.

Is this a professional account? And do you sell new items? Only new items?
The reasons given are laughable..

It’s in their T&Cs, by commercial sales they talk about buying new from suppliers to resell. After that, it can be circumvented.

The biggest problem is my blocked wallet, I would really like a solution, I don’t think this happens for general blockages

I hereby formally notify you to immediately unblock my account and the sum of €5000 which is wrongfully withheld therein, within eight days of receiving this letter. Failure to comply will result in me initiating without delay all necessary legal proceedings to recover my funds and seek compensation for the damages incurred.

Summary of facts:
– My account, with 1000 followers and 500 reviews, was blocked without notice under the pretext of « suspicion of commercial sales, » even though Vinted requires affected sellers to switch to a professional account, which I have done.
– To date, €5000 from my transactions are blocked, without any justification or clear communication from your end.
– In accordance with Article 1103 of the Civil Code, contracts must be performed in good faith. The withholding of my balance without valid reason constitutes a clear violation of this contractual principle.

Legal consequences of your breach:
The blocking of my account and the retention of my funds without legitimate cause are equivalent to:
– An abusive breach of a commercial contract (Article 1184 of the Civil Code);
– An infringement of my property rights over the funds concerned (Article 544 of the Civil Code);
– An unfair commercial practice, prohibited by Article L. 121-1 of the Consumer Code.

I remind you that any abusive retention of funds constitutes a fault that engages your civil liability and may be reported to the Consumer Fraud Directorate (DGCCRF) as well as lead to legal action for forced payment with damages.

Formal requests:

  1. Immediate unblocking of my account and my €5000 within 8 days.

Thank you for your wonderfully well-written message. I finally have access to the wallet after spamming their « customer service, » even though the block is irreparable. I wouldn’t know how to explain it.

Hoping this helps other people.

For my part, I use this address vinted@vinted.fr and generally get rather appropriate and quite fast responses.

I have been blocked on Vinted since May 2024 for a perfectly obscure reason. I have sent numerous emails in English and French but have always received the same robot-generated response. I contacted my legal protection service, but they will not cover it because it is a company outside of France.
I have contacted the CNIL (National Commission on Informatics and Liberty) + FEVAD (Federation of E-commerce and Distance Selling) - No response to date.
I am continuing the fight.

Your message is very well written, I’ll keep it aside just in case; however, in my opinion, it would be wiser to cite one of the articles dealing with unfair commercial practices located in the Commercial Code and not the Consumer Code; if the applicant is a professional seller, the relationship between the seller and the platform falls more under the Commercial Code than the Consumer Code in my opinion.
