PRO Sellers: Turnover declaration and mandatory registers

A demonic tax. €90, at my level, is too much!
It’s very deceitful because you have to pay it for an ecological reason, except that at my level, apart from Japanese imports which have a larger carbon footprint, everything else is purchased on French soil and even recycled for my packages. I feel like I’m just paying ADELPHE and Co., and not their so-called ecology project, with no return on contribution!
The site asks me to establish a project to reduce my carbon footprint. What a joke!
I explained that I work alone, from home, with adapted and very often recycled packages.
From January, I will no longer produce paper invoices (since it will be the law). My « pollution » will therefore be all the more reduced because there will be no more paper and less electricity.
My production of « waste » is minimal, as is my own carbon footprint, compared to companies employing a hundred people in their premises and making thousands of imports and exports daily…
They should add at least 2 tiers: those who sell less than 5,000 units per year and those who sell between 5,000 and 10,000. Their first tier being below 10,000, capped at €90, is abusive.

What’s this story about an eco-tax to pay? I’m not aware of it. The only thing I pay in addition to URSSAF and taxes is the contribution for consumer mediation, which is apparently mandatory when doing distance selling… €90 every 3 years, I believe.

One thing that’s bothering me a bit: I created my micro-enterprise in October 2023, I had sent the form for the CFE, and to this day, I have never received a CFE contribution request.

Is this normal? I think I was exempt for 2023, but for 2024, did I need to send something? I thought I had read that you only had to send the document the first year. Or is it with a one-year delay and they will ask me for the CFE for 2024 this year?

I sent a document the first year (initial declaration if I remember correctly) and after that I didn’t have to do anything. On the other hand, I don’t receive anything on paper, I have to check on the tax website (professional, not personal) to see what I have to pay. Did you go check? Normally it falls in October/November each year.

But so, is it URSSAF that communicates our turnover to them each year, or is it based on what we declared for income tax?

EPR Contribution

It’s indicated as producer but it’s also for resellers (professionals of course: they need cash up there!)

Vinted mentions it to us when we go on Vinted Pro but quickly (again to disclaim responsibility) and fortunately they don’t check it yet but maybe that will come….

I would be surprised if the REP contribution applied to the self-employed scheme.

Generally yes, it’s the following year and payable in December, so if nothing for you at the end of the year, I invite you to contact the tax authorities to check if it applies to you…

Indeed, but it was a salesperson in micro-enterprise who told me about the REP before I switched to professional status, so it’s worth checking (it’s always the same: do you take the risk or not?! :rofl: I don’t know what the penalty is if you don’t pay :wink:)

To try and put it simply, it’s a financial contribution that professionals pay to organizations to recycle waste. It’s not new, but for a few months now, the government has been forcing marketplaces (Amazon, eBay, Rakuten, Vinted, etc.) to apply the legislation.

Who is concerned?

ALL professional sellers. This is not specific to Vinted; even if you sell on your own website, you are legally required to participate in the EPR.

Recycling Streams – What are they?

There are currently about twenty recycling streams (this is constantly evolving). Each stream is managed by one or more approved organizations. A product type corresponds to a stream (e.g., furniture, textiles, toys). If you are the PRODUCER of the products, you must register (and pay) for each type of product you sell. If you resell second-hand products, you do not need to register for these streams.

Household Packaging Stream

This stream is an exception because ALL professional distance sellers must contribute to the household packaging stream. It doesn’t matter what they sell or the packaging they use. Even if you don’t buy any boxes and recycle 100% for your packages, you are (unfortunately) legally required to participate.

Example 1 – Second-hand clothing

You are not the producer and do not participate in placing clothing on the market. Therefore, you only have the household packaging stream to pay.

Example 2 – Second-hand toys

You are not the producer and do not participate in placing toys on the market. Therefore, you only have the household packaging stream to pay.

Example 3 – New toy imported from China

You sell new products that you import yourself from China. In this case, you are the producer by placing the product on the market for the first time. Therefore, you must pay for the toy stream in addition to the packaging stream. However, in the case of Vinted, these items are not « massively » allowed by the terms and conditions of sale.

How to subscribe to the household packaging stream?
There are three approved organizations: Citeo, Adelphe, Léko. For low volumes, Citeo offers an annual flat rate of €80 excluding tax (i.e., €96 including tax) to cover packaging. I would recommend going through them.

What happens once registered?

Once registered, you will obtain an identifier (called an IDU) which must be entered on Vinted. You will then be compliant. This identifier is public and will likely be verified by Vinted; it will be very difficult to avoid with a professional account. Your account will probably be blocked if you do not act.

Do I need a VAT number to register with the household packaging organizations?

Yes, even if you are VAT exempt, you can request a VAT number free of charge from your SIE (Service des Impôts des Entreprises). This does not mean you will be subject to VAT. If you self-assess VAT online on shipping costs and other services, you must have already requested this number. If not, this is an opportunity to get compliant and pay VAT (the famous cents).
